(hereafter referred to as REVINGTON) must abide to the terms and conditions of the registered company as found below in the privacy and copyright policies, and terms of service (TOS), agreements.This copyright policy, privacy policy, and terms of use agreement covers REVINGTON’s ("we" "us," or "our") file transfer/storage services (the “Service”, basic and management models of the Document Management Service), REVINGTON’s websites - base URL revington.net (the “Site”), and all sites and web pages contained in it. By using the Site you consent to the copyright, data practices, privacy policy, and terms of service described in this Statement and Agreement, as the same may be updated from time to time. To Opt out of this agreement discontinue use of the REVINGTON websites and services. REVINGTON HOSTING
REVINGTON provides its service to you, subject to the following Service Terms, which may be updated by us from time to time without notice to you. When using REVINGTON’s services, you agree to the following terms.  Further, you agree to review our terms of service at least monthly to ensure you are in compliance with any modifications.  REVINGTON makes no guarantee about system uptime; however, our past experience has proven over 99% uptime. DESCRIPTION OF SERVICEREVINGTON’s Document Management Service (hereafter referred to as either the “site” and or the “service”) consists of 2 different service options, the basic model and the full / management model. The basic model provides a client with online file upload, storage, and transfer capabilities of the documents required under the Condominium Property Act for their registered condominium (Section 44 in Alberta). It also allows for the creation of web pages through the built in HTML editor which creates web pages in a manner similar to creating a word document. The full management option includes online file upload, storage and transfer capabilities of the section 44 documents, numerous other document types, as well as any other documents and types that the condominium corporation can think of requesting a heading for. If under the numerous headings for different types of documents (each with its own attributes), the condominium requires another type of document heading with its own access rules and attributes, they can request it to be added and inform us of who can access it and at what time. For example, a new document could be viewable only by directors until the “approved” button is selected by a director and then it will become viewable by all owners, or perhaps they want everyone from renters on up to see it at all times after the initial upload. Along with the ability to create their own web pages with the built in HTML editor, the full management option also includes a discussion forum a trouble report system for directors, unit owners, and renters to report on and track the progress of any identified issues at their condominium. You understand and agree that the Service is provided "AS-IS" and that REVINGTON assumes no responsibility for the timeliness, deletion, or failure to store any user communications or personalization settings.  We reserve the right to change this verbiage as needed.  Enterprise private labelling is available for additional fees should you have the need to remove the standard REVINGTON branding. YOUR REGISTRATION OBLIGATIONSIn consideration of your use of the Service, you agree to: (a) provide accurate and complete billing information and (b) update your billing information if changes occur. If you provide any information that is inaccurate, REVINGTON has the right to suspend or terminate your account and refuse any and all current or future use of the Service.  REVINGTON BILLINGOnce you sign up for the introductory Document Management Service (Management or Basic Options) you will be billed for the non-refundable one-time setup and yearly service package fees (basic or management option). This does not include users registering for an existing site.  If paying via credit card via telephone, internet, or in person, your charges will show on your credit card statement as Condominium Accreditation Program. Payment can also be made at our office address as listed on the website or your invoice by cheque, or cash. REVINGTON bills you at the beginning of each year on the date corresponding to your yearly service renewal fees. Your first year’s fees are due in full. The yearly fees, not including the one-time setup fee, will continue automatically until your REVINGTON account is canceled. All fees paid at the beginning of the yearly service are non-refundable, although there are no long term contracts and your website may be turned off at your request anytime, with no future billings, other than any outstanding balances on the account. All currency references are in Canadian dollars. Prices quoted for all services exclude all applicable taxes. Canadian residences will be charged provincial and federal sales tax (GST), as required by law.  REVINGTON also retains the right to change its pricing structure for the yearly service amounts (both management and basic service options) after the introductory periods are over. This will not affect your original introductory rate during the first year of your service. If, due to the uncertainties in this newly developing industry, the fees are changed you will be informed prior to your renewal date and have the option to terminate. Your real name, address, and credit card number you provide here for billing purposes are only temporarily stored in our web system. Once your order is processed and your credit card is charged for the setup fee, your credit card information is deleted from our web based system.  YOU MUST PROVIDE ACCURATE BILLING INFORMATION IN ORDER TO RECEIVE THE SERVICES ORDERED. YOU MUST PROMPTLY UPDATE ANY BILLING INFORMATION TO KEEP YOUR ACCOUNT CURRENT, (Such as a change in billing address, or a change in directors in charge of the DMS account). IF YOU FAIL TO PROVIDE REVINGTON ANY OF THE FOREGOING INFORMATION, YOU AGREE THAT REVINGTON MAY CONTINUE CHARGING YOU FOR ANY SERVICES PROVIDED UNLESS YOU HAVE TERMINATED YOUR SERVICE (REQUESTED IN WRITING). Your non-termination or continued use of the services reaffirms that REVINGTON is authorized to invoice you for the services provided at the beginning of each year your renewal comes due. Once REVINGTON sends this invoice to you, you will be responsible for such charges. Your charges may also be paid in advance if you so choose. LATE CHARGE; COLLECTION COSTSThe amount due to REVINGTON for your services must be paid no later than 30 days after the billing date; you are not entitled to carry forward a balance. You agree to pay late charges that may be assessed by REVINGTON on your past due amounts. The late charge will be 1% per month (or 12% per annum) on the total amount due. REVINGTON reserves the right to refer your Account to a third party for collection in the event of default. You agree to pay all costs incurred in the enforcement of this Agreement and in collection of any delinquent amounts due, including reasonable attorneys' fees and costs. CANCELLATION AND TERMINATIONIf your credit card is invalid for any reason, charged back, or if REVINGTON does not receive payment in another form, your account may be cancelled immediately at REVINGTON’s discretion. If you choose to cancel your account, your cancellation will take effect at the end of the billing cycle in which you cancelled. At the end of your billing cycle, your account will be terminated. You agree that REVINGTON may, under certain circumstances and without prior notice, immediately terminate your REVINGTON account, and possibly even ban your REVINGTON membership. REVINGTON shall not be liable to you or any third-party for any termination of your account, any lost files, or access to the Service. Cause for such termination shall include, but not be limited to:
  • breaches or violations of the TOS,
  • requests by law enforcement or other government agencies,
  • a request by you (self-initiated account deletions),
  • discontinuance or material modification to the Service,
  • unexpected technical issues or problems,
  • extended periods of inactivity,
  • forces of nature and
  • use of an illegal, stolen, or fraudulent credit card.
REVINGTON ACCOUNT, PASSWORD AND SECURITY
You are responsible for maintaining the content of your REVINGTON site, and you are fully responsible for all activities that occur under your REVINGTON site.  If you purchased the service through a “Designated Condominium Associate” (DCA) and received the applicable discount, you will find a user account preinstalled "DCA - Name Here" on your site. Likewise, a banner / picture with a link to the DCA’s own site will be displayed on your site. All other sites may also see the same user account and setup. We require that this account remain active in an owner status on your site, this is for monitoring, training, support, service, and compliance purposes. Like any other web site, there are also user accounts with complete ADMIN status on your REVINGTON site which we require to remain active for technical, support, training, service, and compliance purposes.  On rare occasions we may audit sites to ensure compliance of conduct and use agreements. If you have any questions about the use of these accounts, please let us know and we will be happy to further explain. CONDUCT / DATA PRACTICES
You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content"), whether publicly or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not REVINGTON, are entirely responsible for all Content that you upload, post or transmit. You agree to NOT use the Service to:
  • Upload, post, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
  • Harm minors in any way;
  • Impersonate any person or entity, including, but not limited to, a REVINGTON Admin, Moderator, Merchant, Member or otherwise misrepresent your affiliation with any person or entity;
  • Forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;
  • Upload, post, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
  • Upload, post, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
  • Upload, post, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
  • Upload, post, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  • Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
  • Intentionally or unintentionally violate any applicable local, state, national or international law.
  • "stalk" or otherwise harass another; or
  • Collect or store personal data about other users.
You acknowledge and agree that REVINGTON may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to:
  • comply with legal process;
  • enforce the TOS;
  • respond to claims that any Content violates the rights of third-parties; or
  • protect the rights, property, or personal safety of REVINGTON, its users and the public.
  • You understand that the technical processing and transmission of the Service, including your Content, may involve
  • transmissions over various networks; and
  • changes to conform and adapt to technical requirements of connecting networks or devices.
 REVINGTON’S PRIVACY POLICYYour billing information and REVINGTON Hosting account is protected in our Privacy Policy (Found below this terms of service agreement) and will not be used for advertising purposes or sold to other parties. REVINGTON will not be held responsible and/or liable for information that members choose to share through this service. We strongly recommend that members exercise forethought and caution prior to disclosing any personal information while using these services.  INDEMNITYYou agree to indemnify REVINGTON, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you transmit through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another. DISCLAIMER OF WARRANTIESYOU EXPRESSLY UNDERSTAND AND AGREE THAT: YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. REVINGTON EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. REVINGTON MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS; (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS; AND (v) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM REVINGTON OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS. LIMITATION OF LIABILITYYOU EXPRESSLY UNDERSTAND AND AGREE THAT REVINGTON SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF REVINGTON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE. NO VIRUS TRANSMISSION; DAMAGESREVINGTON may immediately terminate any account which it determines, in its sole discretion, is transmitting or is otherwise connected with any virus creation, transmission, and or harmful code. In addition, because damages are often difficult to quantify, if actual damages cannot be reasonably calculated then you agree to pay REVINGTON liquidated damages of ten dollars (CDN $10.00) for each virus incident is traced to your REVINGTON account. Otherwise you agree to pay REVINGTON’s actual damages, plus 50% of the actual damages in disruption fees to the extent such actual damages can be reasonably calculated.  VIOLATIONSPlease report any violations of the TOS to gking@revington.net         REVINGTON CONDOMINIUM MANAGEMENT & CONSULTING Inc. REVINGTON is the sole owner of the information collected on this site. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. REVINGTON collects information from our users at several different points on our website and in person.
Information You Upload into REVINGTON
All client data uploaded into our system is stored in a secure location. REVINGTON will not sell or rent any client data loaded into our system. Only Authorized “Designated Condominium Associates”(when the service is provided to you through a DCA) will have owner status to your documents for monitoring, support, service, training, and compliance purposes. Any unauthorized access by REVINGTON’s administrators (Only the website administrators have complete access) to any of the files stored by a client for any purpose other than providing customer support, service, training, compliance, technical development, and or maintenance will result in immediate termination of that said network administrator.
Cookies
This site makes use of the technology known as “cookies”. A cookie is a small data file that certain Web sites write to your hard drive when you visit them. A cookie file can contain information such as a user ID that the site uses to track the pages you have visited. However, the only personal information a cookie can contain is information you supply yourself. A cookie cannot read data off your hard disk or read cookie files created by other sites.  If a user rejects the cookie, they may still use our web site.
Log Files
We use IP addresses to analyze trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.
Sharing
In the future (not currently), we may share aggregated demographic information with 3rd parties in the case they would like to know aggregate demographics of our audience. This is not linked to any personal information that can identify any individual person. We do not share personally identifiable information with 3rd parties.

Security
This website takes every precaution to protect our users’ information. When users submit sensitive information via the website, your information is protected both online and off-line.
The physical servers that we store personally identifiable information on are kept in a secure collocation facility that only network administrators have access to. This facility provides security 24 hours a day, 365 days a year and guaranties our servers against power outages by using automated backup power systems. You may periodically receive administrative emails that are related to the primary usage of our service. You may not opt-out of administrative emails.
